Bhopal Union Carbide Toxic Waste Transfer and Disposal Case

In January 2025, the Madhya Pradesh government transferred 337 tonnes of hazardous waste from the abandoned Union Carbide factory in Bhopal to the Pithampur industrial area for trial incineration. This waste, a legacy of the 1984 gas disaster, sparked massive protests in Pithampur, as residents and activists argued that no adequate environmental impact assessment or public consultation was conducted and feared dioxin and furan emissions. Police cracked down, arresting hundreds of demonstrators. Petitioners including Satinath Sarangi and Rachna Dhingra approached the Supreme Court, seeking to halt the disposal. The Court allowed the trial burns under strict real-time monitoring by an expert committee, igniting a nationwide debate on toxic accountability.

In February 2025, the Supreme Court permitted the trial incineration of the waste in Pithampur, subject to oversight by a technical expert committee and real-time emissions monitoring. The court directed strict adherence to safety protocols and ordered the suspension of operations if any adverse environmental parameters were detected.

Whether the state had fulfilled mandatory requirements of environmental impact assessment, informed consent of the host community, and scientifically established the safety of incineration technology for legacy Union Carbide waste before proceeding with the transfer and trial burns.
