Reiwa 6 (Wa) No. 27 Fraud Case

In early 2025, the Tokyo District Court heard the case Reiwa 6 (Wa) No. 27 against Park Jin-ho, a South Korean national, for organized fraud. Park was accused of participating in a transnational telephone scam ring that targeted elderly residents in Tokyo. Operating from a call center in Seoul, the group impersonated police officers and convinced victims to transfer large sums of money under the pretense of investigating financial crimes. Japanese police, collaborating with South Korean authorities, traced the calls and arrested Park during his visit to Japan. The prosecution presented call logs, money transfer records, and witness testimony. Park claimed he was a low-level operative unaware of the full scheme. The case highlighted cross-border judicial cooperation and the challenges of prosecuting internationally dispersed cyber-enabled fraud.

The Tokyo District Court found Park Jin-ho guilty of fraud and participating in a criminal organization. He was sentenced to 4 years in prison with forced labor, and the court ordered the confiscation of equivalent criminal proceeds. The court ruled that the digital evidence was legally obtained and admissible. An appeal was filed but not yet resolved as of mid-2025.

The central dispute was whether Park acted as a knowing core member of the fraud ring or merely as a minor, unwitting assistant. The defense argued that Park had been deceived about the nature of the job, while the prosecution emphasized his repeated involvement and the significant sums transferred. A secondary dispute concerned the admissibility of digital evidence obtained from South Korean servers under mutual legal assistance, with the defense challenging the chain of custody and privacy safeguards.

The case intensified public concern in Japan over the surge of international phone scams, leading to enhanced public awareness campaigns and strengthened bilateral agreements between Japan and South Korea on joint investigations of cyber fraud. It also prompted domestic discussions on protecting elderly citizens from sophisticated social engineering attacks and on the need for faster cross-border digital evidence sharing protocols.
