Koons v. United States

On June 4, 2018, the U.S. Supreme Court decided Koons v. United States. The case stemmed from Jerry Dean Koons and co-defendants being convicted of conspiracy to distribute methamphetamine, facing a 10-year mandatory minimum. The district court granted safety-valve relief under 18 U.S.C. § 3553(f), excusing the mandatory minimum, but refused to apply a two-level mitigating role adjustment under the Sentencing Guidelines. The lower court believed the adjustment could not produce a sentence below the original mandatory minimum. The Fifth Circuit affirmed. The Supreme Court unanimously reversed, holding that once a defendant satisfies the safety-valve criteria, the mandatory minimum is entirely removed; the sentencing court must then calculate the Guidelines range including any applicable mitigating role reduction, regardless of where the resulting range falls. The ruling clarified that safety-valve relief restores the ordinary guideline process for low-level, nonviolent drug offenders.

The Supreme Court unanimously reversed the judgment of the Fifth Circuit, holding that once the safety valve applies, the mandatory minimum does not constrain the sentencing court. The case was remanded with instructions to apply any applicable mitigating role adjustment when calculating the advisory Guidelines range.

Whether a defendant who qualifies for the federal safety valve and is thus exempt from a mandatory minimum sentence may also receive a mitigating role adjustment under the Sentencing Guidelines, even if the resulting advisory range falls below the original mandatory minimum.

The decision resolved a circuit split and promoted uniformity in federal sentencing. By confirming that safety-valve relief fully removes mandatory minimums, it allowed thousands of nonviolent, low-level drug offenders to receive significantly shorter sentences. The ruling strengthened judicial discretion and underscored a commitment to proportionality and fairness in the administration of federal drug laws.
